In the good old days in order for a creditor to get a charge over your property they had to get a County Court Judgment against you. However if you asked for a Variation of an Order (i.e. pay lower monthly amounts). If this was approved by the courts, then the creditor was forced to accept monthly payments. A creditor could only apply for a charging order if you then missed a payment.
