Subject: Help - Is it the end of the line - Reposession?

I've been really stupid. I had a county court hearing today where the building society asked for repossession of my property. I owe £5,000. Phoned building society this morning and explained situation and that i could pay more each month to pay back the arrears and also paid over (ie more than) my monthly payment this morning. They said say that at the court. Well, i got lost, got directed to the wrong court building and turned up late. The judgement was made without me - repossession in 4 weeks. Help!! They gave me a form to 'set aside' the judgement and i guess i will need legal advice on that. Is there any chance of not losing my house.? Incidentally, it says in the evidence that i got a notice - but i never got anything that i had to sign. SO i wondered if i could add that to my plea - ie all the steps haven't been gone through correctly?  . I worked out that i could repay my loan which goes with my mortgage in 2 months and the arrears to my mortgage in 18 months to 2 years and would be happy for them to take it off my salary. Has anyone any experience of this? I am so angry at myself for missing the hearing. In the meantime, I want to try and get money back from credit cards so that i could pay back the debt sooner - that is if i can keep my house. Do you think I have any chance? I have a reasonable income and was taking the eivdence of my monthly income to the court with me, though also have a lot of debt. Any advice or comments gratefully received. ps got behind because of having difficult time at work which made me depressed and completely bhind o n my paper work. However, I paid approx £400 over my normal monthly payment in june and about £150 over normal payment today. so they do have evidence of my paying. help!!

This is by no means the end of the line. Providing that you can show the courts that you have a solution to the problem, you stand a very good chance of not being evicted.

Do you have unsecured debts that are giving you a problem?

Hi Phoenix 57,

What a shame about the mix up with the courts!

As you have spoken to the building society, I suggest you formally place to them the realistic propsal to pay what you can afford against the arrears - on top of your monthly repayment.

How come you are in this situation? Plenty of people end up facing reposession through no fault of their own and a judge will not make matters worse for you either- onfact they are genuinely helpful and if you are making an effort - they will not force you out of the home.

If going direct to your mortgage lender doesnot help and they are not willing to listen, you can present a N244, with a court fee I am afraid, to the court with evidence of what you can afford each month. Payslips, letter froma  friend saying they will pay or something similar.

This will need to be done very soon so work out realistically what you can contribute and go the the lender, or the courts. This should stop the reposession.

Please ensure however that you can afford to stay in the property - £5k is a large amount to pay back.

With reagrds to claiming money from credit cards - do you mean reclaiming credit card charges? Or potentially writing them off? I agree with the previous post by the legendary Johnny Debt, Emma from ReactUK is a wizz at claiming unlawful charges and is red hot on claiming compensation or even writing off credit agreements - This ranges from credit cards to secured charges and mortgages.

Definitley worth a phone call to her - she is a busy lady so keep trying - if not e-mail her at emma@reactuk.com. She will be able to explain all about the process of claiming compensation or even writing off lending to you.

If you do have any unsecured lending - this can always be reduced to help establish more funds to pay for your mortgage arrears - lots of options for you.
