One of my mates are due to go bankrupt shortly - does anyone know the process at Bournemouth courts?

Just knowing what he has to do will help keep him calm!

Hi TMTB,

For bankruptcy Bournemouth County Court is what is termed as a walk in court which means that you do not have to book an appointment for bankruptcy.

Your friend will have to be there at 8.30 in the morning and that can be any day of the week (except weekends of course) as Bournemouth deals with bankruptcy 5 days a week.

The bankruptcy clerk of the court will ask your friend into the interview room where she will thoroughly check forms 6.27, 6.28 statement of affairs (soa) and form A if your friend has it.

Once the forms have been checked she will ask your friend to swear that the information is correct and get your friend to sign the documents as evidence.

She will ask your friend for the £485.00 court and official receivers fee. If your friend has a low income, is on job seekers allowance or has child tax credits coming in then the court fee of £150.00 could be waived.

Click on Forms and Guidance and search for form EX160 your friend can fill it in and hand it over at the beginning of the bankruptcy interview. Even if your friend isn't on benefits it's always worth having a shot at getting the fee down you never know.

Once the soa has been signed and the money paid she will then tell your friend that the soa will have to go in front of the judge who will look it over and put his/her stamp on it for bankruptcy. The soa is looked at between other cases so your friend will be asked to go away and return later at around 11.30 - 12.00 to collect the judgement and receipt for the fees. On rare (and I mean rare) occasions the judge may have questions which will mean a trip up to the court room but it is VERY rare. There's a great cafe on site so your friend can nip in there and grab a coffee and a bite if desired. If you ask Johnny Debt he's always bleating about how good the full english is there ( most of it ends up down his shirt ;-)

Your friend will receive a call from the official receiver later that day or the next depending on how busy they are.

The one thing I make sure with my clients is that the statement of affairs is filled in correctly as this can cause challenges when sat with the Bankruptcy Clerk of the Court. She is a nice lady but a stickler for getting things correct and they are not an advisory service so your friend will need to be correct with his information.
